TVS will keep its date with Flame

VS Motor Company, which has filed a Rs 250 crore defamation suit against Bajaj Auto’s patent infringement claims against it, will stick to its plan to roll out its new 125 cc bike ‘Flame’, which is at the centre.

Industry sources said the suit may well have been filed to prevent Bajaj from filing an injunction to delay the launch of Flame in December.

Over the last two months, Bajaj Auto has alleged infringement of a patent for twin spark plug technology by TVS even as it has itself launched a new bike with this twin spark plug technology, called ‘XCD’. But weren’t the two companies talking to each other in an informal manner over the last few weeks to sort out this contentious issue?

TVS Motor’s managing director Venu Srinivasan told DNA Money, “There is always a dialogue going on through SIAM between industry players but then things happen outside this as well”.





He did not comment when asked if TVS anticipates an injunction move from Bajaj.

But he asserted that the bike would be launched on schedule.

“We will begin production in November and the bike would be launched in December, as planned all along”.

Bajaj Auto CEO S Sridhar declined to comment on the defamation suit.
Swadeshi Jagran Manch’s S Gurumurthy has been acting the mediator to solve this dispute between TVS and Bajaj and is believed to have held several meetings with representatives of both companies over the last few weeks.

The spat came out in the open on September 2, when Bajaj Auto alleged patent infringement by TVS and said it would sue the Chennai-based two-wheeler maker on three counts: using the same technology for the same purpose (on a bike engine); using it for the same engine size (125 cc) and with the same construction.

Later, Bajaj decided to wait for ‘Flame’ to be launched before taking any decision on going ahead with this suit.
